Punitive damages are different from compensatory damages, which cover things like medical bills, lost wages, and pain and suffering. Instead, punitive damages are intended to punish a person or corporation whose behavior was intentional or malicious, and to serve as a warning to others.
In Maryland, punitive damages are simply not available in the vast majority of personal injury lawsuits. They may only be awarded in exceptional cases where clear and convincing evidence shows actual malice or extreme disregard for the safety of others. Because of this high standard, when they are warranted—such as in cases involving fraudulent conduct or intentional harm—they can significantly increase the value of a case.
