Emily C. Malarkey

Founding Partner

Emily C. Malarkey has represented injury victims for her entire legal career. She is a highly respected trial lawyer and a founding partner at Malarkey Perlin, LLC, with over 20 years of experience representing victims of catastrophic injury.

 

Emily's strengths lie in her close attention to detail, desire to understand "what really happened," and genuinely compassionate nature. She leaves no stone unturned, and will not give up when she believes that something is not as it should be. â€‹

 

Following law school, Emily clerked for the Honorable Sally D. Adkins of Maryland's intermediate appellate court. Emily then built a thriving career as a trial attorney for the injured. She has secured multiple verdicts exceeding $1 million and has argued appeals that have resulted in published precedent. She is an Associate of the American Board of Trial Advocates (ABOTA), and has served the Maryland Association for Justice (Maryland's largest advocacy organization for the civil justice system) as a long-time member of the Board of Governors and Amicus Committee, and as President from 2022-2023.

Emily actively works to improve the legal system, most recently serving on the Baltimore County Judicial Nominating Commission and as Legislative Chair for the Maryland Association for Justice. Emily regularly testifies before the Maryland General Assembly in support of laws to protect the civil justice system.

 

A long-time Maryland “Super Lawyer,” Emily also has been recognized by Best Lawyers in America as Medical Malpractice Lawyer of the Year in 2026, and was on the Maryland Daily Record’s Power List for Personal Injury and Medical Malpractice lawyers in 2022. A natural teacher, Emily enjoys sharing her legal expertise through speaking engagements and published articles.

A Maryland native and product of 12 years of Catholic school, Emily earned the prestigious White Blazer award at her alma mater, Notre Dame Preparatory School. Emily then graduated summa cum laude from the University of Maryland, College Park, where she became an avid Terps hoops fan. She graduated with honors from the University of Maryland School of Law, where she was a member of the National Trial Team, and was inducted into the Order of the Barristers, a national honor society recognizing skill in trial advocacy.

Emily is licensed to practice law in all Maryland and Washington, D.C. local and federal courts, as well as the U.S. Fourth Circuit Court of Appeals. She has also been specially approved to handle cases in other states, including Delaware, West Virginia, and Virginia.

​

When she's not in the office, you can find Emily at her kids' sporting events, whipping up something yummy in the kitchen, or lounging on the beach with a good novel in her hands.
